China has spelt out four situations in which a foreign national can lose their permanent residence status in the country.
The rules are contained in Article 24 of the Measures for the Administration of Examination and Approval of Foreigners’ Permanent Residence in China. Under it, the National Immigration Administration (NIA) has the power to cancel permanent residence already granted and to confiscate or declare invalid the holder’s Foreign Permanent Resident ID Card.
Here are the four categories:
- National security risk: Foreigners considered a threat to China’s national security or national interests.
- Deportation sentence: Anyone handed a deportation order by a Chinese people’s court.
- Fraud: People who got their permanent residence by cheating, such as submitting false documents or using other unlawful means during the application.
- Staying away too long: Foreigners who, without permission, spend less than three months in China in a year, or less than one year in total across any five-year period.
The framework also makes it clear that foreigners who don’t meet the standard conditions for permanent residence will not have their applications accepted in the first place. The NIA handles both the approval and the withdrawal of the status.
In simple terms, China treats permanent residence as a privilege that comes with continued obligations, not a one-time grant. Foreigners who already hold it are expected to keep a real physical presence in the country to hold on to it.
